    ORLANDO, Fla. – The attorney for three NASCAR fans injured last weekend during a race the day before the Daytona 500 says they are exploring a possible lawsuit, but some experts say they could face tough obstacles in winning damages.
    Matt Morgan, the Orlando-based lawyer for the fans, said at a news conference Tuesday than any suit would focus on the safety fence used along the track at Daytona International Speedway. He said he hopes to reach a settlement with NASCAR to avoid a lawsuit.
    More than 30 people were injured last Saturday after a horrific wreck in a second-tier NASCAR series race sent chunks of debris, including a heavy tire, into the stands. Morgan declined to provide the identities of his clients, but said two of them were seated directly in front of the crash and sustained injuries ranging from a fractured fibula to abdominal swelling. All have been released from the hospital.

    I added a poll. I don't feel they should sue or they should lose if they do. A fence can't stop everything. There will still be pieces that will make it though the holes in the fence.

    I was lucky to see part of the race...the first NASCAR event I have seen here in Thailand (drinking at a bar with a great system :hungover:). I watched the accident and it was pretty bad to say the least but when you go to an event that is dangerous anything can happen and it is a chance that you take. I feel that NASCAR should foot the medical bills but that should be the end of it. The only way you could be fully protected is if there was so much steel barrier between the track and the spectators there would only be a dense metal wall to watch.

    You know that those same people who are considering lawsuits would've been ticked if there hadn't been any wrecks that day. It's a race, wrecks happen. Bad ones can throw pieces and there's only so much that they can do to protect the fans who want to view the race from trackside. If they put up plexiglass walls like those that keep Shamu in his tank at Sea World, there's a possibility of a fire melting them. Or the sun would be so magnified and the lack of breeze would lead to people passing out from the heat and they'd sue saying that it should be chain-link fence.

    Some people just look for an excuse to sue.

    I think that it is human nature to "enjoy" a small crash at the track but only if nobody it hurt. I will say that I am guilty of this as well. But to use a wreck to make money is sad. It may take years of litigation to find out if they win or lose and the amount rendered. I would have just taken a piece of the wreckage and my admission ticket and start hawking them out to sports collectors. Quicker and no lawyer fees either.

    I agree. There is only so much that can be done to make it safe as well as giving the fans the experience they are looking for.

    The thing is some would have no problem finding a lawyer that would take the case with no up front fee. Some would just expect them to settle so it would be quick easy work for the lawyer.

    I do believe that those who were seriously injured to be entitled to some type of compensation. I'm sure some of them will have some crazy looking medical bills. Those who are in actual pain should get some money for pain and suffering also but no amount that is out of the ordinary.
